Terms and conditions of service

Te damos la bienvenida a autóctonus. “autóctonus” es el nombre comercial, marca y denominación social de GSG Experience SL, con NIF B21868831, y domicilio en Calle Barria (Kalebarria) número 3, bajo, de Durango (Vizcaya, España), desde donde ofrece un servicio que conecta a personas locales que quieren compartir su mundo, con viajeras y/o viajeros que buscan vivirlas, a través de su Plataforma digital.

Estos Términos y Condiciones regulan el acceso y uso de nuestra Plataforma digital, disponible a través del sitio web y aplicación móvil, que conecta a personas (físicas o jurídicas) autóctonas (en adelante, "personas locales" o “personas autóctonas”) que desean compartir Experiencias culturales, naturales o personales, con personas viajeras (en adelante, "usuarios y/o usuarias" o “personas usuarias”) que buscan vivir dichas Experiencias de manera auténtica. Al acceder o utilizar la Plataforma, aceptas estar legalmente obligado por estos Términos y Condiciones.

Definitions

1.1. Platform: Website, mobile application and related services operated by GSG EXPERIENCE SL, under the autóctonus brand.

1.2. Local person, autochthonous person, Local: A person who publishes and offers an Experience or activity through the Platform.

1.3. Traveler, user: A person who uses the Platform to search, book or participate in Experiences offered by Local people.

1.4. Experience: Activity, tour, service or event offered through the Platform by a Local, intended for the enjoyment of the User.

Registration and use of the platform

2.1. To use certain Platform features, both Local people and Experience users must register by providing truthful, complete and up-to-date information.

2.2. All people registered on the platform are responsible for maintaining the confidentiality of their access credentials and all activities carried out under their account, as well as compliance with specific rules that may apply to each sector.

2.3. autóctonus may suspend or cancel accounts in case of breach of these Terms and Conditions, or when it detects fraudulent activity or behavior harmful to its user community.

Publication of Experiences: obligations of the local person

3.1. Local people may publish Experiences detailing their content, conditions, duration, location, photos and price.

3.2. The Local person guarantees that the Experience complies with applicable local laws and regulations, whether by geographic area and/or sector, and assumes full responsibility for its correct execution.

3.3. Specifically, the Local person must comply with tax, fiscal and social security regulations, and declares awareness of their obligations, including those relating to issuing invoices to each traveler of the Experiences managed, for the total price of the Experience carried out, as well as the filing and payment of the corresponding quarterly VAT returns and other tax obligations, when the activities are subject to said tax.

3.3. Whether or not the activity constituting the Experience is subject to compulsory civil liability insurance, autóctonus requires Local people to take out appropriate insurance for the Experience(s) offered, guaranteeing the safety of each user. To this end, it is recommended to carefully read the policy's terms and conditions, as well as coverage details and damage exclusions. autóctonus reserves the right to require Local people to prove they have taken out said appropriate insurance policy, and that its coverage extends to all users of each Experience, which is an essential requirement for maintaining the profile and associated Experiences. Failure to prove this may result in expulsion from the Platform and/or cancellation of the Experience.

3.4. autóctonus does not verify or guarantee the legality, safety or truthfulness of published Experiences, acting solely as a technological intermediary.

3.5. After each Experience, Local people and users have the opportunity to review each other. Reviews must be truthful and may not contain discriminatory, offensive, defamatory or other terms that violate these Terms and Conditions or applicable legislation. autóctonus does not verify the truthfulness of reviews, so they may be inaccurate or misleading.

Bookings and payments

4.1. Users may book Experiences available on the platform and make payment using the methods authorized by it.

4.2. autóctonus will retain a commission, as the price of the intermediation service it offers, for each booking made, the amount of which will be communicated in advance. Currently the Platform's fees amount to 15%% of the price of each Experience. To this end, the Platform will issue, for each completed Experience, the corresponding 15%% invoice to the Local. These invoices will be available in the Local's own profile.

4.3. Payments will be managed by external payment service providers, whose terms and conditions users also agree to. Currently STRIPE is the company providing the payment collection service to the Platform.

Cancellation policies

5.1. Cancellations by Experience users:

Cancellations notified at least five (5) days in advance: full refund.
Cancellations with less than five (5) days' notice: 50%% refund.

5.2. Cancellations by the Local person:

The cancellation by the local person must always be due to force majeure.
In any case, cancellation with more than 30 days' notice will not incur a penalty.
In the event that a local cancels an Experience booked by a user, the Platform will generally apply a 5%% discount to the traveller on the next plan they book.

5.3. Repeat offenders: autóctonus reserves the right to suspend or cancel the accounts of users or Locals with a repeated history of unjustified cancellations.

Discount policies

6.1. On the part of autóctonus:

The autóctonus Platform reserves the right to make any discounts and promotions it deems appropriate within its operating margins. In this way, when the Platform deems it appropriate, it may create offers, also having the power to maintain, eliminate, or modify such offers, at its discretion.
The platform may also launch promotional campaigns with additional non-cumulative discounts, unless expressly indicated.

Protocolo de interrupción inmediata ("botón rojo")

7.1. En situaciones de conflicto, incomodidad manifiesta, peligro o incumplimiento de la normativa durante una Experiencia, tanto la persona usuaria como la persona local podrán activar la funcionalidad denominada “botón rojo”.

7.2. Activar el botón rojo implica la cancelación inmediata de la Experiencia, al menos con respecto a las partes afectadas, y la apertura de un expediente por parte de la Plataforma para investigar lo ocurrido. La Plataforma decidirá en cada caso, y tras escuchar a las partes, entre otras medidas posibles, y a salvo de las medidas legales oportunas que puedan derivarse, si procede la devolución al viajero de la parte proporcional, o si procede la baja de alguno o la totalidad de los participantes en el conflicto.

7.4. Users and locals may use the red button a maximum of two (2) times. If this frequency is exceeded, the platform reserves the right to suspend or close the repeat-offending account.

7.5. In any case, any form of physical or verbal aggression will be an immediate cause for permanent expulsion from the platform.

7.6. Likewise, the Platform also reserves the right to cancel or remove plans that, even without having received any red button, have a low rating from users or do not meet the quality standard the Platform considers optimal.

Use of personal data

8.1. Some parts of the Platform allow users to enter, share or send comments, text, photos, audio, video, information and other content (hereinafter, the «Content»). By submitting Content, in any form and by any means, locals and users grant autóctonus a non-exclusive, worldwide, royalty-free, sublicensable and transferable licence, for the duration of the protection period of the rights so granted, to access, use, store, copy, modify, create derivative works from, distribute, publish, transmit, broadcast, stream and otherwise exploit such Content for the purpose of providing or promoting the autóctonus Platform, on any medium or Platform known or unknown to date and, in particular, on the Internet and social networks. If the Content includes personal information, it may only be used for these purposes if such use complies with applicable data protection laws in accordance with autóctonus's Privacy Policy. In cases where autóctonus pays for or facilitates the creation of Content, it may own such Content if established by additional terms or commitments. In any case, locals and users are solely responsible for all Content submitted to the Platform and warrant that they own the rights or are authorised to grant autóctonus the rights referred to in these Terms. If any Content infringes or violates the intellectual property or privacy rights of third parties, liability will rest with that person. Discriminatory, obscene, harassing, misleading, violent and illegal content is expressly prohibited. Locals and users agree that autóctonus may offer and use automatic services or tools to translate Content, including their own, without guaranteeing the accuracy or quality of such translations, and it is the responsibility of those persons to confirm their fidelity.

8.2. By registering and using the platform, both locals and users expressly consent to the processing of their personal data by the said Platform for service operational, statistical, promotional, advertising, and service improvement purposes, including for its own activities as well as transmission to third parties. All in accordance with autóctonus's privacy policy.

8.3. Image rights assignment agreement. Users and locals expressly consent that the images that locals add to the Platform may be used for operational, statistical, promotional, advertising, and service improvement purposes, including for its own activities as well as transmission to third parties.

8.4. autóctonus reserves the right to use said data in accordance with its Privacy Policy, which forms an integral part of these Terms and Conditions of Use.

Amendment of conditions, rates and policies

9.1. autóctonus reserves the right to modify these Terms and Conditions at any time, including rates, commissions, cancellation policies and discounts.

9.2. Modifications will be notified by email and/or through the Platform, and will be effective from the date of publication. The date of the last revision will appear at all times.

Prohibited conduct

10.1. The following is expressly prohibited:

Publishing illegal, unsafe Experiences or those that infringe third-party rights.
Deceiving, impersonating identities or intentionally altering the truthfulness of offers.
Engaging in offensive, discriminatory or abusive conduct.

The commission of any of the aforementioned conduct authorises autóctonus to block and/or cancel the accounts and activities of the affected persons, as well as, where appropriate, to take the appropriate legal action.

Intellectual property

11.1. All content on the Platform (texts, images, videos, design, logos, software, etc.) is the property of autóctonus or its licensors.

11.2. Any reproduction, distribution or unauthorized use of such content without the prior written consent of autóctonus is prohibited.

Limitation of liability

12.1. autóctonus acts as a mere intermediary between Local people and registered users on its Platform, and therefore does not guarantee the quality, legality, availability or safety of the Experiences.

12.2. In the event of an incident in any of the Experiences handled through the Platform, autóctonus's liability is limited, at most, to the amount effectively paid by the user for said Experience.

12.3. Users freely assume and shall be solely responsible for any risks that may arise, especially in sports or high-risk activities. For greater safety, the Platform offers users the option to take out travel or adventure activity insurance with Europ Assistance or any insurer the user deems appropriate. In any case, autóctonus reserves the right to cancel or block Experiences that do not have the insurance referred to in section 3.3 of these Terms and Conditions. In the case of travelers not residing in Spain, they must take out specific insurance as the insurance proposed by the Platform, Europ Assistance, does not cover such cases.

Legal notice

autóctonus does not endorse or guarantee the existence, provision, conduct, safety, quality, legality or suitability of any Experience, local person, user, listing or third party, nor does it guarantee that the identity checks or criminal background checks of registered persons (where applicable) will reveal all past misconduct or prevent future misconduct. Any reference to «verified» registered persons (or similar term) only indicates that the person has completed the corresponding verification or identification process. autóctonus is not responsible for interruptions to the internet service or telecommunications infrastructure that are outside its control and that may prevent the availability of the Platform. autóctonus may temporarily restrict, with due regard to the legitimate interests of local persons and users (for example, by providing prior notice), the availability of the Platform or specific areas or functions thereof, when necessary due to capacity limits, the security or integrity of the servers, or to carry out maintenance measures that ensure or improve the functioning of the Platform.

autóctonus will not be liable for any delay or failure arising from abnormal and unforeseeable circumstances beyond its reasonable control whose consequences could not have been avoided despite all efforts to the contrary, including, by way of illustration but not limitation, acts of God, wars, terrorism, riots, embargoes, acts of civil or military authorities, fires, floods, accidents, pandemics, epidemics or diseases, strikes or shortages of transportation services, fuel, energy, labour or materials.

Applicable legislation and jurisdiction

14.1. Spanish law applies to these terms and conditions.

14.2. Any dispute shall be submitted to the Courts and Tribunals of the town of DURANGO (VIZCAYA) unless the applicable legislation provides otherwise.
